SONGPEOPLE OFFICIAL PROMOTION RULES
These Songpeople Official Promotion Rules (the “Rules”) apply to all promotions run by Songpeople, a trading name of Entertainment Media Research Limited, including, but not limited to, the Points Program and prize draws, as promoted on Songpeople’s website (the “Website”).
Songpeople may modify the Rules by notifying you by placing a reasonably prominent notice on its website homepage and a link to the changes (“Change Notice”), so it is important that you check them periodically. Continued use of the Website and participation in surveys after the Change Notice is posted is considered acceptance of the Rules, and any modified terms included therein. Any such change shall take effect on the date specified in the Change Notice and all activities after such date shall be governed by the new Rules.
PART A – POINTS PROGRAM
1 ACCUMULATION OF SONGPEOPLE POINTS.
1.1 Once you have joined the panel, Songpeople points will be awarded when you undertake various online activities on the Website.
1.2 The activities that will allow you to earn Songpeople points may change from time to time, at Songpeople’s discretion. Any change will be made by means of a Change Notice (see above). These activities will be clearly set out on the Website or within these Rules.
1.3 Currently, you can earn points by completing most surveys. Where a survey does not carry Songpeople points, this will be clearly stated on the invite at the beginning of the survey.
1.4 Songpeople may suspend, terminate, revalue or modify all or part of the Points Program value structure and offers by means of the Change Notice (see above). Songpeople may adjudicate all Songpeople points discrepancies at its sole discretion, and you shall abide with the decision of any adjudication. If the Points Program is terminated, you will be notified and given 2 months in which to redeem your points.
1.5 Songpeople will try to credit your account as soon as practicable after completion of a survey but, in any event, Songpeople Points will be credited to your account no later than 30 days following survey completion or entry into a prize draw and will be available for redemption as soon as they are credited to your account. Songpeople takes reasonable care to ensure Songpeople points are recorded and credited accurately to your account but we cannot guarantee 100% accuracy (e.g. we may amend credits where any credit or debit is done erroneously or accidentally whether in your favour or to your detriment). You are responsible for ensuring that your Songpeople points are correctly deposited and you should notify Songpeople within 45 days of completion of a survey or prize draw if Songpeople points have not been correctly posted to your account. Songpeople shall not be liable for any losses suffered due to any errors in the posting of points, but shall use reasonable endeavours to correct any error as soon as practicable.
1.6 If you unsubscribe from the Songpeople panel your Songpeople points total will be reduced to 0.
2 SONGPEOPLE POINTS VALUES
2.1 You will receive a certain number of Songpeople points per completed activity (dependent on complexity). The number of Songpeople points available for any activity will be stated on the Invitation.
2.2 You can view your total number of Songpeople points online by visiting the Members’ Page of the Website. Songpeople points expire after two years if an account is dormant due to inactivity for two years.
2.3 Songpeople points are personal to you and are not transferable without Songpeople’s prior written permission. They are not considered to be property, and as such, you cannot sell, transfer or assign your Points to any other person without Songpeople’s prior written permission.
3 REDEMPTION OF SONGPEOPLE POINTS
3.1 You can only redeem Songpeople points if you have a minimum of 2000 points and your account is in good standing.
3.2 All Songpeople points must be redeemed online. To redeem Points, you should go to the Members’ page and click on “SONGPEOPLE Points Account”. Then, click on the “Go” button and follow the applicable instructions. Other Songpeople redemption methods may be added or substituted in the future at Songpeople’s sole discretion by means of a Change Notice (see above).
3.3 Each Songpeople point currently has a value within the scheme of 1 pence. Songpeople may change this value by means of a Change Notice (see above). Participation in Songpeople surveys and other promotions are subject to fair and reasonable usage. If Songpeople in its sole discretion reasonably believes or suspects that you may abusing the Songpeople points scheme or any other rewards scheme in any way, whether for personal gain or for commercial purposes (e.g. you have been employed by a rightsholder or other interested third party to complete surveys in that rightsholder’s favour) or if Songpeople considers your responses are not reasonable fair, accurate, honest and genuine (by way of example only, you are found to be completing as many as possible solely to acquire Songpeople points and so quickly that it is likely you have given your responses with little or no thought or consideration whatsoever, Songpeople may suspend and/or terminate your account without liability. If your account is terminated by Songpeople through your default and/or breach of these Rules, you may forfeit all your credits in your account. Songpeople also may bar you from registering for future accounts on this Website or on those of its affiliates.
3.4 Songpeople points can currently be redeemed for gift vouchers. All gift vouchers are subject to third party terms and conditions of the applicable supplier or partner in question. Songpeople shall be solely responsible for sending you your gift voucher (or other applicable redemption reward, depending on the current scheme in force at that time). As such, following sending of the gift voucher or other redemption reward, Songpeople shall no longer be liable for any failure, error, omission or delay relating to the same. If you have any problems redeeming the voucher or redemption reward, please contact the applicable third party supplier or partner, whose contact details will be set out on the voucher or accompanying information supplied.
3.5 The Songpeople points can be redeemed at www.SONGPEOPLE.com. Further details of this arrangement can be found on the Website. Songpeople may change merchandise and gift certificate offers on the Website at its discretion by means of a Change

3.6 The value of your selected reward may not exceed the number of Songpeople points in your account. However, you may select a reward of the same or a lesser value. Any unused Songpeople points will remain in your account for future use and once you redeem Songpeople points, the appropriate number of Points will be deducted from your account.
3.7 Songpeople points are non-negotiable and may only be redeemed for the rewards stated above, or on the Website.
3.8 Rewards received as a result of redemption of Songpeople points cannot be exchanged, returned or redeemed for cash value.
3.9 Songpeople may substitute any reward for a reward of equivalent or higher value if a reward is not available.
3.10 Please note that some third party vouchers may not be used to purchase certain products by persons under a specified age. Please ensure that you are aware of the terms and conditions relating to any third party voucher provider at the time you redeem your points
4 ADMINISTRATION OF REWARDS
4.1 Songpeople may appoint a third party to administer its Songpeople points program and rewards. You should read the PRIVACY POLICY regarding information that will be passed to third parties to administer the Points Program and rewards.
4.2 Songpeople does not accept any liability for any losses suffered by you due to any error or omission by the third party in the administration or delivery of rewards.
5 EXCLUSIONS AND LIMITATIONS OF LIABILITY
5.1 Nothing in these Rules shall exclude or limit either party’s liability for death or personal injury or for fraud or for anything else that cannot be excluded or limited by applicable law.
5.2 Songpeople shall in no way be liable for any indirect or consequential loss howsoever arising under these Rules or otherwise or for any loss of profit, any loss of business, economic loss, data or goodwill. All terms, conditions, warranties and representations that may otherwise be implied into these Rules are hereby expressly excluded to the fullest extent permissible under applicable law.
5.3 Songpeople’s maximum aggregate liability howsoever arising under these Rules or otherwise in connection with these Rules shall be limited to the sum of £100 or the value of the credits in your account at the date the claim arose (whichever is the lower).
5.4 Songpeople shall not be liable for any delay or failure to perform its obligations under these Rules to the extent that the same are caused, whether directly or indirectly, by an event beyond its reasonable control.
PART B – JURISDICTION
1.1 These Rules constitute the entire agreement between you and Songpeople regarding any promotions run by Songpeople.
1.2 These Rules shall be governed by and construed in accordance with English law.
1.3 The parties irrevocably agree to submit to the exclusive jurisdiction of the English Courts in relation to any claim or matter arising under or in connection with these Rules.
